Terms of Service

These Terms of Service ('Terms' or 'Agreement') constitute a legally binding agreement between you ('User', 'you', or 'your') and Motion Studio ('Motion', 'Platform', 'we', 'us', or 'our'), governing your access to and use of the Motion Studio website, web applications, APIs, and digital video creation tools.

By accessing our website, creating an account, clicking 'Sign in' or 'Create account', or utilizing any AI video generation services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately refrain from accessing or using our platform.

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account or use Motion Studio. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

You are solely responsible for maintaining the confidentiality of your account credentials, including your email verification codes and Google OAuth access. You agree to notify us immediately upon suspecting any unauthorized access to your account. Motion Studio shall not be liable for any losses arising from unauthorized account usage.

Motion Studio provides an AI-powered creative production platform for generating commercial User-Generated Content (UGC) style video advertisements and promotional assets. Features include, but are not limited to:

• AI Script & Angle Ideation: Generating hooks, problem-agitate-solve sequences, and commercial calls-to-action.
• Storyboard & Visual Planning: Structuring shot lists, pacing, and visual framing directions.
• Reference Frame Generation: Synthesizing consistent high-definition visual reference frames using user-uploaded product images.
• Voiceover Synthesis: Generating multi-language neural text-to-speech (TTS) voiceovers across supported languages and styles.
• Video Assembly & Rendering: GPU-accelerated video rendering, motion synthesis, and export packaging (9:16 portrait, 16:9 landscape, up to 1080p resolution).

All paid plans, recurring subscriptions, and one-time credit top-up packs on Motion Studio are securely processed and fulfilled by Creem (creem.io), our merchant of record and payment processing partner.

Subscription Plans: When you subscribe to a monthly or annual plan, your payment method will be charged automatically at the beginning of each billing period. Subscription credits are refreshed at the start of each billing cycle.

Credit Packs: Users may purchase one-time credit packs for additional creative capacity. Unlike monthly subscription credits, purchased credit packs do not expire while your account remains active.

Credit Reservation & Consumption: When you initiate storyboard frames or video rendering, the estimated credit cost is reserved atomically in your account. Upon successful completion, the reservation is consumed. If a rendering job fails due to an internal system or network error, the reservation is automatically released and restored to your balance without penalty.

Non-Refundable Computational Usage: Generative AI models and video rendering require dedicated, high-performance GPU compute power that incurs substantial real-time infrastructure expense. Consequently, credits that have been consumed for completed generation jobs are strictly non-refundable.

System Malfunction Protections: If a rendering task fails to complete, or if our servers experience verified downtime that damages your output files, our system automatically restores your credits. If you experience an unresolved technical discrepancy, you may submit a request through our in-app feedback channel within seven (7) days of the incident.

Subscription Cancellations: You may cancel your subscription at any time directly through the Studio Settings or Billing portal. Cancellation takes effect at the conclusion of your current paid billing period; you will retain access to your plan benefits and remaining monthly credits until the period expires. We do not provide prorated refunds for mid-period cancellations.

EU/EEA Consumer Rights: By purchasing digital credits and requesting immediate video rendering execution, you expressly request immediate performance of the contract and acknowledge that you lose your statutory 14-day right of withdrawal once digital service delivery has begun.

Your Uploaded Content: You retain all ownership, trademark rights, and copyright in the materials you upload to Motion Studio (including product photographs, brand assets, logos, and custom voice recordings). You represent and warrant that you own or have obtained all necessary licenses, consents, and permissions to use and upload such materials.

Commercial License for Outputs: Subject to your compliance with these Terms and active subscription/credit terms, Motion Studio hereby grants you a perpetual, worldwide, non-exclusive, sublicensable right to copy, modify, distribute, publicly display, and commercially exploit the video and image outputs generated by you on the platform (e.g., in paid advertising on TikTok, Meta, YouTube, Google Ads, e-commerce storefronts, and marketing campaigns).

No Foundation Model Training: We respect your proprietary brand assets. Motion Studio does not use your private uploaded product photos or confidential project scripts to train publicly accessible foundation AI models without your explicit consent.

You agree not to use Motion Studio to generate, store, or transmit any content that:

• Violates any applicable international, federal, state, or local law or regulation.
• Depicts child sexual abuse material (CSAM) or any exploitation of minors in any form (strictly zero-tolerance).
• Generates unauthorized deepfakes, non-consensual sexual imagery, or defamatory depictions of real individuals without verified consent.
• Promotes hate speech, violence, harassment, illegal discrimination, or terrorism.
• Facilitates fraudulent schemes, phishing, deceptive product advertisements, or illegal substance promotions.
• Infringes upon third-party trademarks, copyrights, trade secrets, or privacy rights.

Inherent Nature of Generative AI: AI video synthesis is an evolving probabilistic technology. Outputs are generated computationally based on algorithmic interpretations of your prompts and reference assets. Outputs may occasionally contain visual imperfections, anatomical variations, or unexpected motion artifacts.

No Guarantee of Commercial Outcome: While Motion Studio provides tools designed for high-performing e-commerce and social UGC ads, we do not guarantee specific marketing metrics, viewer engagement, click-through rates (CTR), conversion rates, or sales revenues resulting from videos produced using the platform.

THE PLATFORM AND ALL GENERATED OUTPUTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTION STUDIO, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100 USD) OR THE TOTAL AMOUNT PAID BY YOU TO MOTION STUDIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You may terminate your account at any time by contacting our support team or deleting your account via Studio Settings. Upon termination, your right to access the platform will immediately cease.

Motion Studio reserves the right to suspend or terminate your account with or without prior notice if we reasonably determine that you have violated these Terms, engaged in fraudulent activities, or created liabilities for the platform or third parties.

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding individual arbitration rather than court proceedings.

We reserve the right to revise or update these Terms at any time. When material modifications occur, we will provide notice by updating the 'Last Updated' date at the top of this document and displaying a notice in the web application. Your continued use of the platform following the posting of revised Terms constitutes your acceptance.
